Internships only under employment contracts from 2027
The latest third version of the draft Internships Act has been referred to the Standing Committee of the Council of Ministers.
The draft provides for:
- internships to take place solely under a fixed-term employment contract not exceeding six months, with the possibility of concluding a further contract with the same host organisation if the total internship period still falls within that limit;
- an internship allowance for a full monthly internship working time of at least 65% of the minimum wage;
- the exclusion of certain items from calculation of the internship allowance, including long-service bonuses, disability severance pay, overtime pay, night-work allowance and length-of-service allowance.
This marks a significant change from earlier versions of the draft, under which an internship was to be based on a separate internship agreement rather than an employment contract. Only the latest version introduces requirement to conclude a fixed-term employment contract with the intern.
The Ministry of Labour has announced that it will prepare model internship agreements and certificates of internship completion, which are to be published on the website of the Ministry of Family, Labour and Social Policy, to make it easier for employers to apply the new rules.
The draft regulations are expected to enter into force on 1 January 2027.
