President signs latest changes to labour law and rules on sick leave

On 7 January, the president signed two amendments that are significant for employers and employees. The Act of 4 December 2025 eases certain formal requirements in the Labour Code, whilst the changes of 18 December 2025 concern the Social Insurance Institution's (ZUS) adjudication system and the rules on sick leave.

The Court of Justice of the European Union has ruled on a case concerning work in several countries

In 2002, Locatrans, a transport company based in Luxembourg, employed a French national as a driver, whose employment contract was governed by Luxembourg law. The driver initially worked in various European countries, but over time began to carry out transport mainly in France, which in 2014 resulted in the obligation to register the driver in the French social security system. In the same year, after refusing to reduce the driver’s working hours, Locatrans terminated the driver's contract.

Draft bill implementing the Pay Transparency Directive on the government's legislative agenda

On Tuesday, 25 November, a draft bill comprehensively implementing the Pay Transparency Directive was entered into the Council of Ministers' list of legislative and program work (UC127). On this occasion, an outline of the new regulations was revealed.

The Ministry of Family, Labour and Social Policy has announced that it will compile by the end of this year a draft list of occupations most in-demand.

Are the intended changes for the better? No more confirming the legality of foreigners' stay with a stamp in their passport.

Alongside the introduction of the EES (Entry/Exit System), which will ultimately replace passport stamps confirming foreigners’ entry to and exit from the EU, the Polish authorities are also planning to abandon other stamps relating to foreigners. These include stamps confirming the submission of residence permit applications and the legality of a foreigner’s stay while awaiting a decision on the issuance of the relevant permit.

Unexpected rise in rate of unemployment in July 2025

The Central Statistical Office reported that the registered rate of unemployment in Poland rose to 5.4 per cent in July 2025 in comparison to 5.2 per cent in June. That is unusual in the context of the seasonal labour market when unemployment usually stabilizes or declines during the summer. The number of registered unemployed exceeded 830,000 which is the highest level since the beginning of the year.
